FAQs from FEMA Lawyers in Delhi
What is the Foreign Exchange Management Act of India?
The Foreign Exchange Management Act of India, enacted in 1999, is the law that governs all foreign exchange transactions in the country. It replaced the older FERA and came into force on 1 June 2000. The FEMA act in India aims to facilitate external trade and payments and to promote an orderly foreign exchange market. It classifies transactions into current account and capital account categories and empowers the Reserve Bank of India to regulate them.
Who needs to comply with FEMA laws in India?
FEMA in India applies to all residents, non-resident Indians and foreign entities dealing in foreign exchange or cross-border transactions. Any person making foreign investment, borrowing abroad, remitting funds or acquiring foreign assets falls within its scope. Our FEMA lawyers help each of these clients meet their reporting and approval obligations.
What are the penalties for contravening the foreign exchange act in India?
Penalties under the foreign exchange management act of India can be up to three times the sum involved in the contravention where that sum is quantifiable, or up to two lakh rupees where it is not. A continuing contravention attracts a further penalty for each day the breach continues. Many breaches can be regularised through compounding, which our team handles.
How can your FEMA lawyers assist my business?
We advise on structuring, secure the necessary RBI approvals, complete every filing and represent you in any enforcement or compounding proceeding. Whether you are bringing capital into India or investing abroad, we make the FEMA act in India work for your transaction rather than against it.
What is the difference between current and capital account transactions under FEMA?
Current account transactions cover day-to-day dealings such as trade payments, travel, education and medical expenses, and are generally permitted freely. Capital account transactions alter assets or liabilities across borders, such as investments and property, and often require RBI authorisation. Our FEMA lawyers advise on which category applies and what approvals your transaction needs.
